Justicia Transicional: Alcances, Límites Y Desafíos Del Componente De Justicia En El Modelo Colombiano

El proyecto se ocupará del estudio e investigación de aspectos claves del modelo transicional colombiano. Se hará énfasis en el estudio del contenido del deber de investigar, juzgar y sancionar y de los mecanismos que están ubicados en la triada, hoy ampliada, de verdad, justicia, reparación y garantías de no repetición. Principales desafíos del modelo, como es el caso del trabajo, apenas en ciernes, de la Jurisdicción Especial para la Paz, la función renovada de la pena en lógica transicional, los límites y alcances de la función de investigación y juzgamiento de graves crímenes internacionales, la coherencia del sistema con las fuentes internacionales y los desarrollos ligados al ámbito internacional, así como la estructura dogmática de delitos especialmente graves y representativos, para apoyar a los operadores en la formulación de criterios más coherentes de imputación, serán estudiados en el presente proyecto.

The project will deal with the study and investigation of the key aspects of the Colombian transitional model. The emphasis will be placed on the study of the content of the obligation to investigate, judge and punish and the mechanisms that are located in the triad, now expanded, of truth, justice, reparation and guarantees of non-repetition. The main challenges of the model, as is the case of the project, just in the making, of the Special Jurisdiction for Peace (JEP), the renewed function of punishment in transitional logic, the limits and scope of the investigation and prosecution of serious international crimes, the coherence of the system with international sources and developments linked to the international sphere, as well as the dogmatic structure of especially serious and representative crimes, to support operators in the formulation of more consistent criteria of imputation, will be studied in this project.
